Do I need a licensed inspector?

Under New York Labor Law (Article 32, § 933), anyone hiring someone to perform a mold assessment or remediation generally must use a licensed mold assessor. This includes situations like:

• Homeowners selling or buying a property who want an official mold assessment report.
• Tenants or property managers requesting mold inspections for insurance or legal purposes.
• Businesses or commercial property owners hiring a third party to inspect for mold.

In other words, if you are paying someone to assess or remediate mold, that individual must hold a New York State Mold Assessor License.

⚖️ Exemptions (Who Can Perform Assessments Without a License)

According to New York Labor Law § 933:

1. Residential property owners assessing or remediating their own home.
2. Non-residential property owners, or their employees, assessing or remediating an apartment building they own with 4 units or fewer.
3. Owners, managing agents, or full-time employees assessing or remediating commercial property or larger apartment buildings they own, as long as they are not providing services to the public.
4. Government units or public authorities and their employees performing assessments on property they own or manage.
